Terms of Service

Welcome to Watchd. These Terms of Service ("Terms") form a binding agreement between you ("you") and the publisher of Watchd ("we", "us"). By downloading, installing, or using the app, you agree to these Terms. If you don't agree, please don't use Watchd.

1. The service

Watchd is a free mobile application that helps you track movies and TV shows you have watched, plan to watch, or rate. The app fetches metadata from TMDB. Watchd is not endorsed or certified by TMDB.

2. Your account

• You sign in using a third-party identity provider (Google). You are responsible for keeping that account secure.
• You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Watchd.
• You can delete your account at any time from Settings → Account → Delete account.

3. Acceptable use

You agree not to:

• Break any applicable law or violate anyone else's rights.
• Reverse-engineer, decompile, scrape, or interfere with the service or its underlying infrastructure.
• Upload abusive, infringing, or otherwise harmful content (notes, ratings, etc.).
• Use Watchd to redistribute or commercially exploit TMDB data in violation of TMDB's terms.

We may suspend or terminate accounts that violate these rules.

4. Pricing

Watchd is currently free. There are no subscriptions, in-app purchases, or advertising. We reserve the right to introduce paid features in the future; if we do, current free functionality will remain available under reasonable terms, or you'll be notified in advance.

5. Third-party content

Film and TV metadata, posters, and backdrops are provided by TMDB. All trademarks, copyrights, and other intellectual property in those titles belong to their respective owners. Watchd merely surfaces this content for your personal, non-commercial use.

6. Intellectual property

The Watchd app, name, logo, and design are owned by us. Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable licence to install and use Watchd for its intended purpose on Apple-branded devices you own or control. You may not copy, modify, redistribute, sublicence, or create derivative works of the app.

7. Disclaimer of warranties

Watchd is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not guarantee that the app will be uninterrupted, error-free, secure, or that any content is accurate or complete.

8. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of Watchd. Our total aggregate liability for any claim arising out of these Terms is limited to the greater of (a) the amount you have paid us in the previous 12 months (which, for a free app, is zero) or (b) USD 50.

9. Termination

You can stop using Watchd and delete your account at any time. We may suspend or terminate the service, or your access to it, at any time if you violate these Terms or if we discontinue the app. Sections that by their nature should survive termination (intellectual property, disclaimers, liability limits, governing law) will survive.

10. Apple-specific terms

If you obtained Watchd through the Apple App Store, the following additional terms apply (in line with Apple's Licensed Application End User License Agreement):

• Parties. These Terms are concluded between you and us only, and not with Apple. We — not Apple — are solely responsible for Watchd and its content.
• Scope of licence. The licence granted is non-transferable and limited to use of Watchd on any Apple-branded device that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and support. We — not Apple — are responsible for providing maintenance and support for Watchd as described in these Terms or as required under applicable law. Apple has no obligation to furnish any maintenance and support services.
• Warranty. To the extent permitted by law, we — not Apple — are responsible for any product warranties, express or implied. If Watchd fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation whatsoever with respect to Watchd.
• Product claims. We — not Apple — are responsible for addressing any claims relating to Watchd or your use of it (including product liability, legal/regulatory claims, and consumer protection claims).
• Intellectual property. In the event that Watchd or your use of it infringes a third party's intellectual property rights, we — not Apple — are solely responsible for the investigation, defence, settlement, and discharge of such claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist-supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

11. Governing law

These Terms are governed by the laws of [your jurisdiction], excluding its conflict-of-laws rules. Nothing in these Terms limits any mandatory consumer rights you have in your country of residence.

12. Changes to these Terms

We may update these Terms occasionally. When we do, we'll update the "Effective date" above and, for significant changes, notify you in the app. Continued use after changes means you accept the updated Terms.
